Consumer Terms of Sale

1. Who is the seller
Goods, services and digital products sold through HowToPay in a Merchant of Record sale are sold to you, the consumer, by Confidia Pty Ltd trading as HowToPay (ACN 641 060 782, ABN 65 641 060 782), Unit B1, 13-21 Mandible St, Alexandria NSW 2015, Australia ("Confidia", "we", "us", "our").
Where an order is fulfilled by a contracted Supply Partner, that Partner fulfils the goods or services on Confidia's behalf. The Supplier is the fulfiller; Confidia is the seller under these terms.
2. These terms
These Consumer Terms of Sale apply to your purchase of goods, services and digital products from Confidia through HowToPay. They are governed by the laws of New South Wales, Australia.
3. Placing an order
When you place an order, we confirm acceptance once your payment is processed. We may refuse or cancel an order where it is unlawful, the payment is not received or clears, the item is unavailable, a price or description error is detected, or a fraud or risk concern arises.
4. Price and payment
Prices are shown at checkout in the applicable currency and include or exclude tax as indicated. Payment is processed when you submit your order. Your statement will show "HOWTOPAY".
5. Fulfilment and delivery
Your order is fulfilled by the relevant Supply Partner on Confidia's behalf. Estimated delivery or performance times are estimates, not guaranteed. Timeframes may vary with the product or service and your location.
6. Returns, refunds and cancellations
In addition to your rights under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our Refund Policy describes how refunds, returns and cancellations are handled. Where goods are defective, significantly delayed or do not match the description, or where services are not provided with due care and skill, you may be entitled to a remedy under the ACL. Our goods and services come with guarantees that cannot be excluded under Australian law.
7. Your rights and our liability
Nothing in these terms limits or excludes any right or remedy you have under the Australian Consumer Law or any other law that cannot be limited or excluded. Where a non-excludable right applies, our liability is otherwise limited to the price you paid.
8. Privacy
We handle your personal information in accordance with our Privacy Policy and the Australian Privacy Principles.
9. Contact and complaints
If you have a question or complaint about your order, contact us first and we will respond promptly. You may also make a complaint to the Australian Competition and Consumer Commission (ACCC) or your state or territory consumer agency, or the Australian Financial Complaints Authority where applicable.
10. Changes to these terms
We may update these terms from time to time. Changes apply to orders placed after the change is posted.
